HostPoring.Com is also referred to as "we" and anyone who uses HostPoring.Com's services is also referred to as "you". We reserve full rights to change these terms at any time with or without notice and it is your responsibility to keep track of the changes. However, we will notify you via email if we do make any major changes most of the times. Account Setup:
We set up your account after we have received your payment and we/our payment partner(s) have screened the order(s) in case of fraud. In most cases, we do provide instant provisioning of service(s) but that is provided as a courtesy and we deserve rights to manually process orders if necessary. It is your responsibility to provide us with accurate and valid account information that includes your name, address, and phone number. It is also your responsibility to keep them updated if something changes. We deserve rights to terminate or suspend your services if we find invalid or incorrect account information. In high-risk transactions, we might require you to send us scans of Credit Cards or other necessary information before we can set up the service(s). Domain Registrations are usually instant, but it might take some time for it to get processed in some cases.

Email On File:
You are responsible for providing us with a valid and reachable email address on file so that we can contact you when necessary. We may contact you if we get the report of abuse, to notify you about server maintenance and downtimes or for anything else if necessary. It is your responsibility to keep track of your spam filters and we will not be liable for anything if you are unable to receive the emails we send because of any reasons that include your spam filter. We reserve rights to terminate or suspend your services if we do not hear back from you in a certain period of time in extreme cases.

Third Party Services:
All the transactions with the third party are solely between you and the third party and we are liable for anything that happens on the third party’s side. We will try our best to resolve issues as much as we can, but we cannot provide any guarantee or warranty with anything related to the third party.

Backups and Data Loss:
You use our services at your sole risk. We do not provide any warranty of your data, however, as a courtesy service, we do not backup to VPS Hosting service, Ragnarok Hosting or related services. You may use our backup service as the only backup method, but you are responsible for making backups of your data. We are not liable for any data loss caused by your or our fault.

Payment Options:
HostPoring.Com provides several options for payment, full payment is required before any hosting service is rendered:
a.) PayPal. When you place an order with HostPoring.Com, you have the option of selecting PayPal as your payment preference. PayPal allows you to process credit card payments securely and conveniently. You can also elect to create a PayPal subscription, which will automatically process your payment on the recurring date that you set up the subscription. It is your responsibility to ensure that your credit card information, or PayPal balance is up to date. You must make sure all pre-approved (recurring) payments made towards HostPoring.Com are current and active.
b.) Western Union, M. Lhuillier, Cebuana Lhuillier and other Money Transfer. If you don't have a credit or debit card, and do not have a PayPal account set up, you may choose to pay using Money Transfer. Any "fees" required by using this payment method however, will have to be paid for by the customer.
c.) Globe Gcash, Smart Padala and other Mobile Payment methods. As with money transfers, if it is more convenient for you to pay for your Invoices using the mentioned Mobile Payment methods, we'll accept those too. (As of the moment, these options are only offered to those who live in the Philippines).
d.) UnionBank, Landbank, Metrobank and other bank deposit transaction to those who live in the Philippines. You can pay the invoice through bank deposit and any "fees" required by using this payment method however, will have to be paid for by the customer.

Late Payments:
Renewal invoice is sent 14 days before due and services are renewed automatically when you paid the invoice. We reserve rights to charge extra fees 10% of the amount of non-payment invoice after the due date.

Non-payment Termination:
We the reserve rights to suspend your services if you did not pay within 1 day after due date, terminate your services if you did not pay within 2 days after suspended or take legal action if you fail to pay the invoice(s) after the due date. You agree to provide us with payment for the services that you receive from us. You agree to pay for all the services that you use until you give us a cancellation notice. It is your responsibility to keep your payment information up to date and pay your invoices in time. We will try our best to work with your on any problems that might arise because of the payment processors, but we do reserve rights to take actions in those cases as well.

NOTE: When your service is terminated, all files and data will be deleted.

Cancellation and Refunds:
Cancellations must be done in via the cancellation form provided in the client area. To get to this area, please follow these directions: Client Area > My Hosting Packages > View Details > Request Cancellation. Once we receive your cancellation and have confirmed all necessary information with you via e-mail, we will inform you that your account has been canceled. At this time, your account with us has been canceled. If you do not hear back from us or receive an e-mail confirming this cancellation, please contact us immediately.

We do not provide any refunds on Domain Registrations, SSL Certificates, IP Addresses, VPS Hosting, Dedicated Server, Ragnarok Hosting, Gepard Shield Protection, Setup Fee or any other add-ons/services except for the Web Hosting services are We do provide 30 days money back guarantee without any questions and where we will refund the partial refund for the remainder of your payment term if you wish to cancel your services. If your hosting plan came with any of the above-mentioned addon’s while purchasing, the price of those services would be deducted while providing the refund, and in some circumstances can be refunded as an account credit.
We reserve rights to cancel, suspend or terminate your services anytime with or without prior notice.

NOTE: Refund requests after the allotted time stated above will not be refunded.

a.) Account Credit Balance / Available Funds.
HostPoring.Com Credit also known as Account Credit Balance is not, and will not be refunded under any circumstances. Please take full responsibility when adding credit to your account. Please also realize that the amount added to your account will be the amount HostPoring.Com receives after PayPal fees have been deducted.

b.) Violations of the Terms of Service will waive/void the refund policy.
Any abuse of our staff in any medium or format will result in the suspension or termination of your services.

Chargebacks and Payment Disputes:
Under this Terms of Service agreement, you must first contact HostPoring.Com to attempt to resolve any billing disputes before contacting your bank or credit card company to dispute the charges. You further agree that any billing disputes must be submitted in writing to our billing department within one month of the invoice payment in question. By using our services you agree to the above policy and to contact HostPoring.Com before contacting your financial institution to seek a resolution. In the event you dispute charges contrary to this agreement, we reserve the right to immediately suspended or terminate your account, the refund will be void and add a $150 collection chargeback fee to your total amount due. HostPoring.Com also reserves the right to refer your account or sell your debt to a third-party collection agency. We also reserve the right to take further legal action against you.

Uptime Guarantee:
The default 99.9% uptime guarantee will apply to HostPoring.Com services. We reserve rights to approve or not approve credits. We are not liable for any losses or problems caused due to downtimes or usage of our services. Third party monitoring services may not be used to justify the downtime because of numerous factors.

We reserve full rights to not provide support if necessary. We do not guarantee that our support staff will be able to fix the issue or help you accomplish some task, but we will try our best. We reserve rights to cancel this service anytime. It is your responsibility to provide us with all the necessary information that our support staff might need in order to resolve your issue or help you with anything. We reserve rights to not provide any support if you are not able to provide us with necessary information that we will need.

Price Change:
We reserve full rights to change prices for any of our services or products. It is your responsibility to keep track of changes, however, we will try our best to keep you updated on our changes.

Coupons and Special Promotions:
If you have used coupons or special promotions to use any of our services, we reserve full rights to take action if any coupon abuse is found.

Account Credit:
You may add extra account credit on your account so that you can pay your invoices without using any external payment processors. Account credit is non-refundable but you can use it to purchase new services from us.

Your service may come with complimentary add-ons without any extra costs. Free add-ons are provided as courtesy service and we reserve rights to cancel/discontinue them anytime. All free ad credits from third parties come with their own restrictions and terms, and it is your responsibility to follow those restrictions and terms.

Employee Abuse:
We will not tolerate any employee abuse, whether that is verbally over the phone, or by any other means like email, support tickets, live support or any other method. We will take strict actions against employee abuse, and we might even terminate, suspend, restrict access or take legal action against anyone involved in employee abuse. Any cursing, yelling, or further intentional disruptive behavior aimed at HostPoring.Com or its employees shall be considered a violation of this Terms of Service agreement. Threats of physical violence will be directed to the proper authorities. No refunds shall be given when the above Employee Abuse clause is a violation and necessitates the termination of an account or services.

Ragnarok Hosting:
a.) A new client can only avail FREE Setup/Installation of (Emulator/SVN, Game Client, Website/FluxCP, Patcher) for one time. You will be extra charge fees if you request to reinstall and including the request to change the name of a server in Emulator/GameClient/FluxCP/Theme/Subdomain/Patcher, the request to create or change the Emulator/GameClient/FluxCP/Theme/Subdomain/Patcher and the request a new hexed/diffed client Exe.
b.) We do not recommend to use this service for those who have no experience in running a Ragnarok server, and our Ragnarok hosting services are self-managed (meaning we only provide support for server connection, hardware, and bandwidth).
c.) The users are must be responsible and accountable for their server backups, movement of NPC’s, item database changes, script changes, source changes, Website/FluxCP changes, game client changes, patcher changes and to any custom modifications that related to our Ragnarok hosting package.
d.) HostPoring.Com provides the RO services above mentioned that needed to set up on your server, but we do not have the rights to any software. The Copyright of Ragnarok Online is still going to Gravity.
e.) We do not guarantee any Emulator/SVN stability due to the still ongoing developing releases.
f.) Ragnarok hosting and any related services are non-refundable.

Gepard Shield GameGuard:
a). No refund once the payment is made.
b). Ownership of Gepard GameShield Anti-Cheat is not transferable or it is a personal license, you can’t resell license or change owner.
c). Lifetime Payment will only need to pay ONCE, as long the hosting service continues.
d). Setup time will take 48 hours or less and If you will change EXE version in the future, it will cost ₱750 PHP or $15 USD one-time pay.
e). A new client can only avail FREE Setup/Installation of Gepard Shield for one time only. You will be charged extra fees if you request the reinstallation.
f). Gepard Shield GameGuard, which here refers to the piece of software, belongs to Functor(Owner).

No warranties:
You expressly agree that your use of the services is at your sole and exclusive risk. The services are provided on an “as is, with all faults” and “as available” basis. HostPoring.Com expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. HostPoring.Com makes no warranty that the services will meet your requirements, or that the services will be uninterrupted, timely, secure, or error free; nor does HostPoring.Com make any warranty as to the results that may be obtained from the use of the services or as to the accuracy or reliability of any information obtained through the services or that defects in any software, hardware or the services will be corrected. Any statements made regarding such matters in promotional materials shall be considered advertising references, and not warranties. You understand and agree that any use you make of any material and/or data downloaded or otherwise obtained through the use of the services is at your own discretion and risk, and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data. HostPoring.Com may make third-party goods, services and/or software available to you that are not part of the services (“third-party services”). HostPoring.Com has no control over the content of third-party services. Use of any third-party services will be at your own and sole risk and subject to the terms and conditions of a separate agreement between you and the third-party. HostPoring.Com makes no warranty regarding any goods or services purchased or obtained through the services or any transactions entered into through the services. No advice or information, whether oral or written, obtained by you from HostPoring.Com or through the services shall create any warranty, whether by implication, estoppel or otherwise, including but not limited to any marketing or promotional materials describing the services on HostPoring.Com’ website. Unless otherwise agreed to in writing, HostPoring.Com does not make a back-up of your site(s) as part of the services. Accordingly, we encourage you to make a back-up of your site(s) on a regular basis.

Limitation on liability:
You are solely responsible for the proper operation of your website and/or conduct of your business and all other matters under your control. In no event shall HostPoring.Com be liable to you for any damages arising from or related to the operation of your website and/or business or failure to operate your website and/or business. This section applies to all claims by you or your end users irrespective of the cause of action underlying the claim, including, but not limited to, breach of contract, tort, including but not limited to negligence, strict liability, fraud, and/or misrepresentation. Regardless of the type of claim or the nature of the cause of action, you agree that in no event will HostPoring.Com, our affiliates, contractors, service providers, employees, agents, or licensors, or any other party involved in creating, producing or delivering the services, technology, or content available on the services (“affiliates”), be liable to you in any manner whatsoever: (a) for any decision made or action or non-action taken by you in reliance upon the information provided through the services; (b) for loss or inaccuracy of data or, cost of procurement of substitute goods, services or technology; (c) for any indirect, special, incidental, consequential, or punitive damages, including but not limited to loss of revenues, loss of profits or loss of reputation, for business interruption or similar action, even if HostPoring.Com has been advised of the possibility of such damages. The total aggregate and maximum liability of HostPoring.Com and the affiliates, arising from or otherwise relating to this agreement (regardless of the form of action or claim) is limited to any amounts you have paid to HostPoring.Com during the six (6) months prior to the accrual of the cause or causes of action.

Changes to these Terms Of Service Agreement:
HostPoring.Com reserves the right to revise its policies at any time without notice.
